Hard Money Lenders of Laguna Beach ("we," "our," or "us") operates this website as a lead-generation service owned and operated by Lead Skills, LLC. We are not a lender. We connect consumers interested in hard money financing with participating lenders who may be able to provide financing. Because this service involves the collection of consumer financial information and the sharing of that information with financial institutions, our practices are subject to the federal Gramm-Leach-Bliley Act (GLBA) and its implementing regulations, including the Privacy Rule and the Safeguards Rule.

This Privacy Policy describes the categories of information we collect, how we use that information, how and with whom we share it, and the choices you have regarding our use of your information.

2. Information We Collect

We collect the following categories of information when you use this website or submit an inquiry:

  • Identifiers. Name, email address, telephone number, mailing or property address, and similar information you submit through our forms or calls.
  • Property and investment information. Property type, property address, purchase price, estimated value, rehab or construction budget, exit strategy, and timeline.
  • Financial information. Information related to your financing request, such as loan amount, loan purpose, existing mortgages or liens, and information a participating lender requires to evaluate your inquiry.
  • Usage data. Technical information collected automatically, including IP address, browser type, device identifiers, referring URLs, pages visited, and date and time of access, including through cookies and similar technologies.
  • Communication records. Records of your communications with us, including form submissions, email messages, phone calls, SMS/text messages, and records of consent (such as the TCPA consent you provided when submitting an inquiry).

3. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiry and route it to one or more participating lenders in our network;
  • Facilitate communications between you and participating lenders;
  • Operate, maintain, and improve this website and our lead-generation service;
  • Detect, prevent, and investigate fraud, abuse, or security incidents;
  • Comply with legal obligations and enforce our Terms of Service; and
  • Contact you about your inquiry by phone, SMS/text, or email consistent with the consent you provided.

4. How We Share Your Information (GLBA Disclosure)

As a lead-generation service, we share nonpublic personal information with third parties as described below. We do not sell your personal information.

  • Participating lenders. When you submit an inquiry, we share your information with one or more participating hard money lenders who may be able to provide the financing you requested. Each participating lender is responsible for its own privacy and information-handling practices once it receives your information. A current list of participating lenders is available upon request.
  • Service providers. We share information with vendors that support our business operations, including website hosting, email delivery, form processing, analytics, anti-spam and anti-fraud security, customer relationship management, and telephony. These service providers are permitted to use your information only to provide services to us.
  • Legal and safety. We may disclose information when we believe in good faith that disclosure is required to comply with applicable law, legal process, or governmental request, or to protect the rights, property, or safety of our users, our company, or others.
  • Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction, subject to the commitments made in this Privacy Policy.

5. Your Right to Limit Sharing

By submitting an inquiry through this website, you authorize us to share the information you provide with one or more participating lenders who may be able to provide the financing you requested. This sharing is necessary for us to provide the lead-matching service you are requesting.

If you do not want your information shared with participating lenders, please do not submit an inquiry. If you have already submitted an inquiry and wish to limit further sharing, you can opt out by contacting us using the information in the "Contact" section below. Please note that opting out will terminate our ability to continue matching you with lenders.

6. Data Security

Consistent with the GLBA Safeguards Rule, we maintain an information security program that includes administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of nonpublic personal information. These safeguards include access controls, encryption in transit for data submitted through our website, vendor oversight, employee training, and periodic review of our security practices. No method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security.

7. Your Choices

Subject to applicable law, you may:

  • Access and correct the information you have submitted by contacting us;
  • Request deletion of your information, subject to our legal and recordkeeping obligations;
  • Opt out of SMS/text messages by replying STOP to any text message from us or a participating lender;
  • Opt out of phone calls by telling the caller you wish to be removed from their list or by contacting us directly;
  • Opt out of marketing emails by clicking the unsubscribe link in any marketing email or by contacting us directly.

Opting out of communications from us does not automatically opt you out of communications from a participating lender with whom your information has already been shared. You may need to contact each participating lender directly.

8. Children's Privacy

This website is not directed to children under the age of 18, and we do not knowingly collect personal information from children under 18. If we learn that we have collected information from a child under 18, we will take reasonable steps to delete it.

9. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide additional notice. Your continued use of this website after an update constitutes your acceptance of the revised policy.
