1. Introduction and Agreement

These Terms of Service (the "Terms") govern your access to and use of this website and the lead-generation services offered through it by Hard Money Lenders of Laguna Beach, a service operated by Lead Skills, LLC ("we," "our," or "us"). By accessing or using this website or submitting an inquiry, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use this website.

2. Our Role: Lead Generation Service

We operate a lead-generation service that connects consumers interested in hard money financing with participating lenders in our network. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including loan approval, denial, rates, terms, fees, and funding timelines, are made solely by the participating lender. Submitting an inquiry does not guarantee that you will be matched with a lender or that a lender will offer you financing.

3. No Offer or Solicitation

Nothing on this website constitutes an offer, commitment, or solicitation to lend, to provide financing, or to enter into any financial transaction. Information on this website is provided for general informational purposes only and should not be relied upon as legal, tax, financial, or investment advice. Any loan programs, rates, or terms referenced are illustrative only and are offered, if at all, by participating lenders subject to their own underwriting, documentation, and approval requirements.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use this website or submit an inquiry. By submitting an inquiry, you represent and warrant that the information you provide is true, accurate, current, and complete, and that you have the right to share any third-party information you submit.

5. Your Consent to Be Contacted

By submitting your contact information and checking the consent box on our inquiry form, you provide your prior express written consent for us and for one or more participating lenders to contact you at the phone number(s) and email address you provided, including by automatic telephone dialing system, prerecorded or artificial voice message, SMS/text message, and email, regarding your financing inquiry. You understand and agree that:

  • Consent is not a condition of purchasing any goods or services or of obtaining a loan;
  • Your information will be shared with one or more participating lenders who may contact you;
  • Message and data rates may apply, and message frequency varies;
  • You can opt out of SMS/text messages at any time by replying STOP to any text, and you can opt out of phone calls by telling the caller you wish to be removed from their list or by calling (949) 796-7809; and
  • A current list of participating lenders is available upon request.

6. Equal Opportunity

We connect borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

When you use this website, you agree not to:

  • Submit false, misleading, or fraudulent information;
  • Submit information about another person without that person's authorization;
  • Use the website or inquiry forms to harass, defraud, or harm any person;
  • Attempt to gain unauthorized access to the website or its related systems;
  • Interfere with or disrupt the operation of the website;
  • Use automated means (such as bots or scrapers) to access or collect content from the website; or
  • Violate any applicable law or regulation.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT SUBMITTING AN INQUIRY WILL RESULT IN A MATCH WITH A PARTICIPATING LENDER OR IN A LOAN OFFER.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, ANY INQUIRY YOU SUBMIT, OR ANY INTERACTION WITH A PARTICIPATING LENDER OR OTHER THIRD PARTY, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Hard Money Lenders of Laguna Beach, Lead Skills, LLC, and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to (a) your use of the website; (b) any inquiry or information you submit; (c) your breach of these Terms; or (d) your violation of any applicable law or the rights of any third party.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that the exclusive jurisdiction and venue for any dispute arising out of or related to these Terms or the website will be the state and federal courts located in Orange County, California.
